What is Tortious Interference and how does it affect Screen Printing?

First we must learn about the legal aspects, then we can get a better understanding of how these type of actions are negatively affecting our industry.

Here is a small Copy/Paste of an interesting article on Tortious Interference:

Competition is at the heart of our capitalist economic system rewarding businesses supplying the best goods and services at the best value.
Despite the high value we place on robust competition, boundaries do exist.
Conduct that may be perceived as just “in your face” competition, may give rise to serious liability under the tort of tortious interference with economic relations.
This article addresses the liability hooks and the tug-of-war between legitimate competition and inappropriate interference with contractual relationships.

A little industry background

Printex entered the USA market a few years ago and experienced difficulty on many levels.

M&R being a fierce competitor unwilling to give up market share monitors every move Printex makes.

The four founding partners of Printex-Poland early on setup Printex-USA, a legal entity in South Carolina, this entity is Printex Group, LLC (PrintexGroup.com)

Printex goes into the marketplace and obtains signed contracts with deposits from screen printers, those screen printers are immediately approached by M&R representatives and encouraged to walk away from their deposits and cancel their orders in exchange for better M&R prices, quicker M&R deliver, and additional M&R favors.

How does this affect Screen Printing?

Simple, if companies that are bringing new ideas to screen printers are unable to gain market share because of unfair competition then the screen printing industry suffers from a "more of the same" mentality.

Where is the incentive for companies to develop superior products without the fair ability to gain market share?

This type of "Bully Tactics" are nothing new for M&R there is a long history of these types of actions in the marketplace.

Why are there a handful of outspoken forum posters?

M&R is consistently driving a wedge between Printex and the Printex customer, in turn creating an environment that lends itself to a rallying of anti-Printex sediment from end users, customers that walked away from deposits/contracts, and brand loyalists.

What does a screen printing internet troll look like?

The easiest question of them all, we refer to them as SPITers, they have nothing better to do with their time then to band together and fight a cause (real or otherwise) M&R has spent countless hours working these internet trolls to attack Printex (see for yourself)

Question the motives and just like in politics "Follow the Money"

The above statement "Tortious Interference" is not true and holds absolutely no merit!

BUYER BEWARE OF ROBERT BARNES With screenprintgear.com,www.spidermachines.com,www.spiderpromo.com

Robert Barnes has stolen money from at least 2, if not more screen printing companies.
Below is a company that Robert Barnes stole $150,000 from and also another company in Clinton Iowa with the owners name Jeff Saxyby. $80,000 was taken from Jeff Saxby and the equipment was never delivered, and the other equipment purchased (Printex) does not work properly.
I encourage you to do research when buying used screen printing equipment, or new screen printing equipments. Clearly Robert Barnes is not an honest, trustworthy salesperson to purchase from.
Feel free to contact the gentleman below and he will honestly tell you that Robert Barnes did not deliver on the purchase and is out $150,000.

Yeah, M&R is the one who's driven the wedge between Printex and their customers, ok, got it.

It had nothing to do with your actions or the problems that the presses were having? Ok, it can be whatever you want it to be.

Are you saying the law is wrong?
Are you saying that Printex isn't legally entitled to complete a ratified contract without the interference of M&R?
Perhaps you should become a lobbyist in DC, then you can Follow the Money!

You own an RPM Revolution right?
Did any M&R representatives encourage you to not buy from Rick Fuqua?
If so, was it after there was a signed contract?
After money was paid?
After you took delivery?
After you used the machine for months?
After you took over the Bill Hood classes?

There is definitely a pattern of behavior, we just need to determine how many companies has M&R done this to.

Buyers Beware of Robert Barnes. He has changed company names many times over the years to elude the fact that he is not an honest person to purchase equipment from.
Feel free to contact the following posters on this board and ask them about their experience with him as he sold them equipment that wasn't as advertised as well as took money from 2 people and never delivered the equipment.
The proof can be told by these contacts below!

Winston, Robert Barnes says follow the money? Follow mine right to his pocket!

Jeff,
How long have you had your 2 Printex presses that don't work properly? Also how long have you been dealing with Printex -Poland in resolving the 80K that Robert Barnes owes yoou, and what is the status from the Printex representative? Any word with what they are going to do to refund your money or deliver your press that you paid for?

Strange I bought a printex and not once did m&r try to steal the deal from us.

Interesting how Robert always finds blame on others always, never is it his fault for trying to over achieve and tarnishing everything he touches.

What I find really interesting you musty admitted printexusa was created by the four partners so that does mean they did rip off sax by since he signed a printexusa contract.

How many times has Robert Barnes been sued??? It's amazing that someone can actually think they are a legit company and have a reputation when they have been sued by so many that has come into contact with him, he has multiple website all basically pointing to the same direction, uses tons of usernames on forums, and just about every ex-employee is discruntled with him.

Why is it that in every other place in the world people rally around the virtuous underdog.

Yet here they don't?

Maybe because they aren't very virtuous.

People LOVE an underdog, but they hate a fly by night crook/shyster!

Follow the money, follow the logic!

Are you saying that Printex isn't legally entitled to complete a ratified contract without the interference of M&R? They are here right, they've sold 15 presses here in the states right? M&R isn't doing anything different than Printex has done...try to sell a press to someone who wants to buy one, simple as that

Perhaps you should become a lobbyist in DC, then you can Follow the Money!

You own an RPM Revolution right? Hell Yes

Did any M&R representatives encourage you to not buy from Rick Fuqua? They encouraged me to buy an M&R

If so, was it after there was a signed contract? They called me the day I signed the contract and asked if it was final and if I was sure that I didn't want to reconsider buying an M&R. What company wouldn't at least try to sell a press to someone who wants one?

After money was paid? They kept in contact with me and in my opinion, they didn't try to "steal" the deal or try to convince me to get out of the contract with RPM. They asked me what they could have done differently and the main reasoning behind them losing the deal. I respect the hell out of that. They wanted to know where and what they did wrong, that tells me a lot.

After you took delivery? No, that would be dumb

After you used the machine for months? Again...dumb
After you took over the Bill Hood classes? WTF does that have to do with the purchase of an RPM Revolution? I am currently teaching a course as I type this, I'm responding to this ridiculous post on our break.

There is definitely a pattern of behavior, we just need to determine how many companies has M&R done this to.

M&R has been very professional towards me and our business despite us buying an automatic from someone else. They maintained a presence in our shop because they knew we would be buying equipment for future needs. We bought a dryer from them and a new manual press because I trust them and because they deserve our business.

Have to admit I did for a start till I realized the underdog actually had rabies, was mad with it and had bit people several times.....

I love the underdog, the start up, the challenger, the newbie, the fresh thinker, the small guy, the injured, the battler always support them in sport etc. But they must be righteous and ethical.

If You do this, than there is no problem but if M&R comes in to the picture its called Tortious Interference. Funny thing is that M&R was MORE expensive that the Printex in the begining. Now that my money is stolen and I am missing a 16 color Prism ll, M&R is actually cheaper.

Rich Hoffman NEVER contacted me to sell me a press after the Printex stealing, I contacted HIM.

EXACTLY, everyone pulls for the underdog... when the underdog is virtuous.
